TERMS AND CONDITIONS: 5STAR GALAXY GRAB PROMOTION

Please read the Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with the Terms and Conditions. If you do not agree with the Terms and Conditions, please do not participate.

The Terms and Conditions set out below apply to all participants submitting entries for the 5Star Galaxy Grab Promotion ("Promotion").

  1. THE PROMOTION:
    The Promotion is conducted by Mondelez South Africa (Pty) Limited, 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa, Tel: 011 253 4000 ("Promoter").
  2. PROMOTION PERIOD
    1. The Promotion will run from 1 May 2019 to 30 June 2019 (“Promotion Period”). No entries received after midnight on 30 June 2019 will be accepted.
    2. The Promotion Period may be extended or curtailed at the discretion of the Promoter.
    3. The Promoter accepts no responsibility for any entries, which are delayed or not received due to any error, omission, delay in operation, transmission, network or software problems or any other reason beyond the Promoter's control.
  3. WHO MAY ENTER
    1. All participants must:
      1. be a natural person and be at least 16 (sixteen) years of age at the date of entry.
      2. be a citizen of the Republic of South Africa and/or legal resident of the country.
      3. be in possession of a valid South African identity document, resident/work permit and/or driver’s licence
    2. The Promotion is not open to employees (or members of their immediate families namely sons, daughters, mothers, fathers, brothers, sisters, or spouses) of the Promoter, their subsidiaries, affiliates, sister companies or any third parties involved in the execution of the Promotion, either directly or indirectly. If any such person wins the Promotion, the Promoter reserves the right to cancel such participation.
    3. Participation in the Promotion constitutes acceptance of these terms and conditions, which the Promoter reserves the right to amend, alter or add to at any time during the term of the Promotion.
  4. HOW TO QUALIFY FOR THE PROMOTION
    1. To enter the competition:
      1. Buy any 1 (one) qualifying 48.5g 5Star at a participating store.
      2. Dial *120*55511# and follow the prompts. Keep your unique code (found inside the wrapper) within reach as you will need it to complete your entry.
      3. Calls charged at 20 cents per 20 seconds.
    2. Qualifying Cadbury 48.5g 5Star Chocolate Bars will include a unique code on the inside of the wrapper. Participating stores will include any and all stores nationally that stock these qualifying 48.5g 5Star Bars.
    3. Each entry constitutes 1 entry into that week’s prize draw (according to the draw dates specified in clause 6.1.5) as well as 1 entry into the grand prize draw on 1 July 2019.
    4. For every 5 entries submitted from the same cellular number, the entrant will receive 5 bonus entries into the grand prize draw for a VW Polo Comfortline with Beats. For example, 5 entries into the weekly draws (the same week or various different weeks) will equate to 5 grand prize entries PLUS 5 bonus grand prize – the entrant will therefore have 10 total entries into the grand prize draw. The 5 bonus entries apply to every entry of a 5th denomination (i.e. 5 entries = 10 entries into the grand prize draw, 10 entries = 20 entries into the grand prize draw, 15 entries = 30 entries into the grand prize draw, and so on). Bonus entries apply to the grand prize draw only, not the weekly prize draws or daily instant prizes.
    5. Please note that no other Mondelez South Africa (Pty) Ltd products are eligible for this Promotion, other than those products mentioned above. The qualifying products are subject to availability at time of purchase.
  5. CAN I QUALIFY MORE THAN ONCE FOR THE PROMOTION?
    1. Multiple entries will be permitted subject to each entry being submitted separately and in accordance with entry requirements.
    2. A person may not win more than one prize within a 6 (six) month period following the first win, nor shall any member of such person’s family (including, but not limited to, aunts, uncles, cousins, grandparents, in-laws, etc.), friends or acquaintances residing at the same address, on the same property (including communes), or within a 2km radius of one another.
    3. The Promoter reserves the right to withhold prizes from any such person, and to reclaim any such prize if a breach of this rule is subsequently discovered or suspected. This applies to any in-store Mondelez South Africa/Cadbury promotions run in various different participating stores (including, but not limited to Cadbury Dairy Milk Slabs, Cadbury Bars, Cadbury Assortments, etc.).
    4. Daily and weekly winners within this competition will still qualify for, and be entered into, the Grand Prize draw.

  7. PRIZE TERMS
    1. The Superbalist virtual vouchers will be sent via SMS and are only redeemable at http://superbalist.com/users/my_account/wallet. Vouchers are valid for 3 years from date of issue and it is the winner’s responsibility to check the issue/expiry date and to redeem the voucher within this deadline.
    2. The UBER voucher code will be sent via SMS and may only be redeemed via the Uber app and used within cities in the Republic of South Africa where the Uber app is available. The voucher expires three (3) years after purchase. Please follow these steps to redeem the voucher: 1) Go to the Payment section in the Uber app; 2) Tap “Add Promo/Gift Code”; and 3) Enter the voucher Code. You must have an active and valid Uber account to redeem the voucher. You may be required to add a secondary payment method to use the voucher with the Uber app if the balance from the voucher is not sufficient to cover the price of your ride.

    4. The winners of the double flight tickets will receive their virtual flight vouchers via email. The flight vouchers will be in the form of 2 x R2000 domestic flight vouchers per winner. The flight voucher is to be redeemed online for local/domestic flights available on the Travelstart website: https://www.travelstart.co.za. The voucher codes can be redeemed for all major destinations and airlines in South Africa. This includes, Lanseria, Johannesburg, Durban, Port Elizabeth, George, Nelspruit and Bloemfontein. Instructions will be provided with the voucher to the winner. The voucher code is to be entered at checkout online. The voucher is valid for 1 redemption only (i.e. it cannot be used for multiple purchases or check outs). The full R2000 value per voucher must be used in 1 redemption; no change or additional vouchers will be issued if the full R2000 value is not used/redeemed. Voucher codes cannot be redeemed for cash and may not be combined with any other coupon/offer/discount or promotion offered by Travelstart, this includes flight sales and/or other subsidised fares. Valid for 1 year from date of issue. It is the winner's responsibility to take note of the voucher expiry date and ensure they use the voucher before the expiry date.     5. The prizes are based on set preselected models/voucher types – winners are not able to choose the model/features/specifications/colour/voucher type of the prize/s and will accept the prize as is at their own risk. Promotional images are merely a representation of the prize and the actual prize may vary. The promoter reserves the right to substitute any of the prizes for a different model/brand/voucher of similar value.
    6. For the grand prize VW Polo 1.0 TSI Comfortline including factory fitted Beats; the cost and arrangement of licensing, registration and insurance is not included and is for the winner's own account. Winners must contact the VW dealer that does the handover to arrange for the legal transfer of any prize and must arrange for third party insurance against damage or loss from the moment possession is taken of the prize. The Promoter shall not be liable for any manufacturing faults, recalls, damage or loss of or to the vehicle once handed over to the winner.
    7. The immediate costs (such as the cost of the prize and delivery) shall be covered by the promoter, upon delivery any further costs will pass to the winner (this includes but is not limited to insurance of the prize, maintenance, or replacement). Any risks in relation to the prizes (such as loss, theft or damages) will pass to the winner once the prize has been delivered/accepted and/or the indemnity form signed.
    8. Should the winner notice any product defects they have 3 months to request the purchase/warranty details specific to the prize. Thereafter no recourse/claims will be allowed, and no further discussions will be entered into.
    9. Prizes (including gift cards/vouchers) are not transferrable, exchangeable and may not be redeemed for cash and if not taken up for any reason, may be forfeited or be the subject of a separate draw or be allocated at the Promoters' discretion to another winner.
  8. AWARDING OF PRIZES
    1. The weekly and grand prize winners (this excludes instant winners) will be chosen from a random draw of entries and contacted via telephone (using the cell phone number used to enter the competition). Winners will be contacted within 7 working days of the draw date. Weekly winners and the Grand Prize winner will be announced on social media (such as Facebook and Twitter) within 1 week of validation. Should winners not want their name and surname to be included in the announcements they are to notify the promoter, in writing, within 2 hours of being confirmed as a winner. The Promoters decision is final, and no correspondence will be entered into. Should the winner not be contactable telephonically within 48 hours, the prize will be transferred to the next randomly selected entry.
    2. Upon receiving a phone call from the Promoter or appointed agent to announce that they are a potential winner (this excludes instant winners), the entrant will be required to provide their identity document and may be requested to provide their original unique till slip for their purchase, dated and timed before their entry date and time, as proof of purchase for the qualifying product. Should the winner not be able to provide a scan or photograph of their identity document and/or original unique slip(s) to the Promoter on request, they will be disqualified. The slip(s) is not to be written on or tampered with in anyway. Validation of supporting documents and till slips by the promoter may take up to 10 working days.
    3. 10 000 Airtime, 55 Superbalist and 25 UBER instant prize winners will be auto-selected based on daily random draws as per the dates specified above (see clause 6.1). Should a participant be selected as an instant winner, they will be notified on the closing screen of their USSD entry and receive their voucher within 1 hour via SMS. The vouchers are in no way guaranteed to all entrants.
    4. The airtime winners will be notified that they have won a R5 airtime top-up and requested for a Prepaid 10-digit cellular number they would like the airtime to be automatically allocated to. Upon receiving a valid 10-digit cellular number the airtime will be automatically allocated to the cellular number within 1 hour of the closing screen notification on the USSD confirming the airtime will be allocated. The promoter is not responsible for any incorrect cellular numbers being provided on the USSD. Airtime vouchers may only be used on Top-Up or prepaid cellular phone accounts. Any customer on any other cellular phone contract will not be able to receive the airtime and will be asked on the USSD string to provide a friend’s cellular number as an alternative.
    5. The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute.
    6. The cash prizes will be paid into the winner’s confirmed bank account (the account is to be listed in the winner’s name and proof of account ownership is to be provided on request, such as a bank letter). Payments will only be made to legitimate banking institutions, based within South Africa. Bank account details to be provided in writing before the transaction will be made; a link to an online bank form will be provided and is to be completed and submitted with a copy of the winner’s identification document. The Promoter will not be liable for any losses caused by incorrect or inaccurate information supplied by winners or discontinued/closed bank accounts. No cheques or physical cash will be issued. Payments may take up to 15 working days to be processed from receipt of the completed online banking form.
    7. The promoter is not responsible for any undelivered SMS vouchers due to any incorrect details being provided by the winner with regards to their cellular number, or any incorrectly redeemed SMS vouchers, expired SMS vouchers or Network related errors. The promoter will not be responsible for any lost or stolen SMS vouchers and no replacements will be made.
    8. Physical prizes will be delivered to the winner’s preferred residential or work address (within major cities) within 4 – 6 weeks from receiving all the requested documentation. Deliveries will only be made to physical addresses (no postal addresses) where someone is able to sign for the prize on weekdays during working hours. Deliveries to high theft risk / special delivery areas will require an alternative address within a major city/town. Should the winner have no alternative address in an area that is not consider as high risk, the supplier will attempt to arrange a collection option from a postal service branch within the nearest major city/town. Should the collection option not be possible or not suit the winner and the only alternative be to deliver to the winner’s home in a high-risk area, the winner will assume all risk involved with the delivery. The immediate costs (such as the cost of the prize and delivery) shall be covered by the promoter, upon delivery any further costs will pass to the winner (this includes but is not limited to insurance of the prize, maintenance, or replacement). Any risks in relation to the prizes will pass to the winner once delivered regardless of who has signed for the parcel at the specified address.
    9. The promoter is not responsible for any undelivered prizes due to any incorrect details being provided by the winner with regards to their preferred delivery address or being unavailable to sign for their prize. The promoter will not be responsible for any lost, stolen or damaged prizes once the prize has been signed for. The courier may allow someone other than the consignee present at the delivery address to sign for the prize delivery if the consignee is unavailable or unreachable – it is therefore the winner’s responsibility to ensure they provide a safe low risk address/destination for delivery.
    10. Winners will be required to sign Indemnities and Consent Forms when accepting their prize.
    11. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.

  9. INDEMNITY
    1. To the extent permitted by the Consumer Protection Act and any other applicable law:
      1. The participant and/or winner(s) hereby indemnify the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Promotion.
      2. The Promoter excludes all warranties (express or implied), representations and liabilities regarding the Promotion (other than for death or personal injury caused by its negligence and/or fraud).
      3. The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age and place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    2. Winners/finalists aged 16 and 17 years of age will be required to provide written parental consent, along with the identity document of their parent or guardian, in order to accept the prize. Should the winner/finalist refuse, or their parent or guardian refuse, the prize will be transferred to the next randomly selected entry.
      1. Neither the Promoter nor its agents or distributors will have any liability in relation to the Promotion.
      2. By participating in the Promotion, participants agree to allow marketing material to be sent to them from the Promoter during and after the Promotion Period. Participants will have the option to opt out with every SMS or email received, with the exception of the first SMS and email.
      3. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by the Promoter in its sole discretion. The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter’s brands into disrepute.
  10. CONFIDENTIALITY
    1. Participants of the Promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.
    2. By entering the Promotion, participants authorise the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
    3. By entering the Promotion, the participant consents that the Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa. Attention: Legal Department. The written notification is to reach the Promoter by no later than the last stipulated draw date.
  11. GENERAL
    1. Any dispute with number ownership (such as more than one individual claiming to be the owner of the same number – verbally or otherwise) will result in immediate disqualification of both the number and the individuals and no negotiations will be entered into.
    2. The promoter is not responsible for any errors, non-deliveries or crossed lines caused by cellular phone service providers or networks and cannot be held liable for any resulting errors or prize misallocations.
    3. You may only enter the Competition as an individual; any entries that, in the Promoter’s absolute discretion, have been made via participation in a syndicate will be disqualified.
    4. Any entries made, in the Promoter’s discretion, via any form of machine assisted intervention enabling multiple entries will be disqualified.
    5. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel the Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
    6. The onus rests on the participants to check the website for updates to the Terms and Conditions.
    7. No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which he/she may have against the Promoter and hereby acknowledges that he/she will have no right of recourse or claim of any nature whatsoever against the Promoter.
    8. The Promoter’s decision is final, and no correspondence will be entered into.
    9. The Promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Twitter or any other social media platform used to promote the promotion.
    10. This promotion is in no way sponsored, endorsed or administered by, or associated with Samsung, Beats, Core, Sony, UBER, Superbalist, Converse and Volkswagen, and the participants acknowledge that they are providing information to the Promoter and their agents only and not to the prize brands.
    11. All entrants in this Competition release all the prize brands from all liabilities and claims arising out of or in connection with this competition and these terms and conditions.
    12. If in part or all of any clause of the Terms and Conditions is illegal, invalid or enforceable:
    13. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible,
    14. It will be severed from the Terms and Conditions, and the remaining provisions of the Terms and Conditions will continue to have full force and effect.
    15. All Terms and Conditions are subject to the laws of Republic of South Africa, and should a doubt or dispute occur, it will be taken before the courts of Republic of South Africa.
    16. The Promotion is not applicable in conjunction with any other offers/promotions offered by the Promoter.
