Terms and Conditions

The Terms and Conditions set out below apply to all qualifying persons (“Participant (s)”) submitting entries and taking part in the Cadbury Give a Little Thanks Campaign (“the Promotion”). Please refer to the below website page for the current Terms and Conditions for this Promotion and FAQs on https://cadbury.co.za/promotions-festive-give-a-little-thanks

 

Please read the Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with the Terms and Conditions. If you do not agree with the Terms and Conditions, please do not participate.

1. THE PROMOTION AND PROMOTER

1.1 The Promotion is conducted by Mondelēz South Africa Proprietary Limited, located at 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa, Tel: 011 253 4000 (“the Promoter”).

2. PROMOTION PERIOD

2.1 The Promotion will run from 2 October 2023 to 31 January 2024 (“the Promotional Period”).
2.2 The Promotional Period may be extended or curtailed at the discretion of the Promoter.
2.3 The promotion period of Cadbury GeneroCity Studio activations will run in December 2023 where you can join in the celebration of giving this festive season. More details will be updated on the promotions page.

3. WHO MAY ENTER

3.1 All Participants in the Cadbury Give a Little Thanks campaign must, at the time of entering the Promotion:
a) Be a natural person and be at least 18 (eighteen) years of age;
b) Be a citizen and legal resident of the Republic of South Africa;
c) Be in possession of a valid South African identity document, resident/work permit and/or driver’s licence;
d) Be residing or be present in South Africa for the duration of the Promotional Period.
3.2 Participation in the Promotion excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter or any third parties involved in the execution of the Promotion, either directly or indirectly (including but not limited to agencies, organisers and/or participating stores of the Promotion) as well as the members of the immediate family (being spouses, life partners, parents, children, brothers, sisters, fathers and/or mothers) and/or business partners or associates of any of the aforesaid persons.

4. HOW TO PARTCIPATE INTHE PROMOTION

4.1 Online Competition Mechanics
4.1.1 For a limited period, participants can visit the Cadbury South Africa website as highlighted above in “PROMOTION PERIOD”. Participants are encouraged to Give a Heartfelt Thank You to someone who has made their year extra special via our website https://cadbury.co.za/promotions-festive-give-a-little-thanks or on social media using the hashtag #CadburyGiveALittleThanks and tagging @Cadbury_SA.
4.1.2 Participants who Give a Heartfelt Thank You through the website, and verify their email address, can stand a chance to receive 1 of 5000 PnP wiCode Vouchers, valued at R50,00 each, subject to availability. A total of 5000 vouchers will be distributed to participants during the “PROMOTION PEROD”, until the vouchers have been exhausted, at which time, no further vouchers will be available.
4.1.3 The competition is not eligible through entry on social media. No entries received after the 5000 vouchers have been distributed, will be considered. The prizes are not transferable for cash.
4.2 Claiming your wiCode Voucher Prize
4.2.1 Once a participant has been identified as a winner, the potential prize winner will receive an email from Cadbury(noreply@cadbury.co.za) which will contain a wiCode voucher to be redeemed for purchase of any Cadbury Dairy Milk Festive Slab or Cadbury Dairy Milk Festive Range Product, and gifted to the person who their Heartfelt Thank You was sent to.
4.2.2 The wiCode voucher will expire 31 January 2024 and may only be redeemed at a PnP for purchase of a Cadbury Dairy Milk Festive Range Product or Festive Range Slab, up to the value of R50.00.
4.2.3. To redeem your wiCode voucher, take your wiCode voucher with your chosen Cadbury Dairy Milk Festive Range Product or Slab to the cashier, show your wiCode: #WICODE to the cashier to redeem. Advise the cashier that you are paying with a wiCode. Provide the 9-digital wiCode to the cashier at point of purchase.
4.2.4. If you are unable to use your voucher, for any reason, before 31 January 2024, the voucher and relevant documentation will be forfeited and the prize will no longer be valid.

5. PROMOTIONAL MARKETING AND HEARFELT THANK YOU’S SHARED ON SOCIAL MEDIA

5.1 Multiple Heartfelt Thank You messages sent and shared via social media, may be identified and shared for use on the Cadbury website, as part of Today’s Generosity. Participation in this promotion and activity gives Cadbury South Africa permission, and the right to utilize your profile picture, any image and message, or part of your message, in marketing messaging on the website and on social media communication.

6. eCOMM ONLINE PARTICIPATING PARTNERS

6.1 The Cadbury Dairy Milk Festive Range Products and Slabs are available for purchase at participating PnP ASAP!, Spar 2U, Checkers Sixty60 partners online, by clicking through from the website to your favourite app to purchase. You can also purchase in store, at participating retailers not mentioned as an eComm online partner on this website.

7. INDEMNITY

7.1 To the extent permitted by the Consumer Protection Act and any other applicable law:
7.1.1 The Participant hereby indemnify the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the Participant’s entrance to the Promotion.
7.1.2 The Promoter excludes all warranties (express or implied), representations and liabilities regarding the Promotion (other than for death or personal injury caused by its negligence and/or fraud).
7.1.3 The Promoter reserves the right, at any time, to verify the validity of Participants (including but not limited to a Participant’s identity, age and place of residence) and to reject any Participant who has not complied with these Terms and Conditions.
7.1.4 Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7.1.5 Neither the Promoter nor its agents or distributors will have any liability in relation to the Promotion.
7.1.6 By participating in the Promotion, Participants agree to allow marketing material to be sent to them from the Promoter during and after the Promotion Period.
7.1.7 The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal, or ridicule or reflect unfavourably on the Promotion as determined by the Promoter in its sole discretion.

8. CONFIDENTIALITY

8.1 Participants of the Promotion are voluntarily providing their personal information (name and email address) to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.
8.2 By entering the Promotion, Participants authorise the Promoter to collect, store and use (not share) personal information of Participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the Participant wish to be removed from all communication.
8.3 By entering the Promotion, the Participant consents that the Promoter may use names and images taken of the Participants for publicity purposes, without any further remuneration being payable to the Participant. All promotional material will become the sole property of the Promoter. However, the Participant has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa. Attention: Legal Department. The written notification is to reach the Promoter by no later than the last stipulated draw date.

9. Activation Details:

9.1 The Cadbury Dairy Milk Give a Little Thanks campaign includes two activations: Johannesburg at Mall of Africa for two weeks from the 12th to the 24th of December 2023, and in Durban at Gateway Mall for one week from the 18th to the 24th of December 2023 during the festive season. During these activations, consumers will have the opportunity to participate in the Give a Little Thanks studio to send messages of gratitude to their loved ones.
The campaign is being conducted by Mondelez South Africa Pty Ltd.

10. Participation:

10.1 To participate, consumers must register at the activation studio and send a digital text or video message to a loved one.
10.2 Participants will be eligible to receive 1 x 80g Cadbury Dairy Milk slab upon successful registration and message submission, irrespective of the number of digital messages submitted. While stocks last.

11. Registration and Entries:

11.1 Each participant is allowed only one registration and one video message, however, will be allowed to send multiple digital messages.
11.2 Participants may visit the activation multiple times during the campaign period.
11.3 Each participant is allowed one entry per day.

12. Disclosure of Third-Party Information:

12.1 By sharing a heartfelt thanks to a loved one through the activation, participants acknowledge that they are disclosing third-party information.
12.2 Participants understand and agree that the event organisers may use the shared messages and content for promotional purposes.

13. Marketing Information:

13.1 By registering for the campaign, participants consent to receiving marketing information from the event organisers during and after the campaign.
13.2 Participants acknowledge that their personal information may be used for marketing purposes and that they can unsubscribe at any time.

14. Video and Image Capturing:

14.1 During the activation, video and images may be captured by the event organisers for promotional and documentation purposes.
14.2 By entering the activation site, participants agree to the event organisers sharing the captured content on their social media platforms and for PR purposes to amplify and report on the activations.

15. Eligibility:

15.1 The activation is open to all individuals who meet the age requirements for participating in such events. Participants of the campaign must:
a) At least 18 (eighteen) years of age;
b) A citizen and legal resident of the Republic of South Africa;
c) In possession of a valid South African identity document, resident/work permit and/or driver’s licence;
d) Residing or are present in South Africa for the duration of the Promotional Period.

16. Admission and Availability:

16.1 The event organisers reserve the right to admit individuals onto the activation stand.
16.2 The sample giveaway of the Cadbury 80g slab is subject to availability. The event organisers cannot guarantee the availability of samples for all participants.

17. Child Safety Regulations:

17.1 In accordance with child safety regulations, children under the age of 18 will not be allowed onto the stand without adult supervision.

18. Identity Verification:

18.1 The event organisers may request participants to provide identity documents to verify their age.

19. Liability and Insurance:

19.1 Participants are responsible for their own actions and behaviour during the activation.
19.2 The campaign organisers will not be held liable for any injury, loss, or damage that may occur during the event.

20. Intellectual Property:

20.1 By participating, participants grant the campaign organisers the non-exclusive right to use, reproduce, and distribute the messages for promotional purposes.

21. Data Privacy:

21.1 Personal information collected during registration will be used solely for the purpose of the campaign and will be handled in accordance with applicable data protection laws.

22. DATA PROTECTION TERMS

22.1 The Promoter through subcontractors/sub processors may have access to specific information which can identify individuals who are consumers (known as “Personal Information” as defined by the Protection of Personal Information Act). The Promoter and its subcontractors shall comply with all laws and regulations applicable to “Personal Information” and any related information.
22.2 The Promoter through its sub-processors warrants that any “Personal Information” will be collected in accordance with applicable Data Protection laws.

22.3 By clicking “SUBMIT”, I confirm, that I have fully read, understood the Cadbury Taste the Action and Win Promotion 2023 terms and conditions as stated here and I agree to participate. I also confirm receiving communication from the Promoter about future promotions and offers.

22.4 Personal information will be retained as long as reasonably and legally required to perform the obligations under the terms of the Promotion.

23. Amendments and Cancellation:

23.1 The campaign organisers reserve the right to amend or cancel the activation in the event of unforeseen circumstances. Participants will be informed of any changes through appropriate communication channels.

24. General Terms:

24.1 By participating, participants agree to abide by these terms and conditions.
24.2 Any violation of these terms and conditions may result in disqualification from the activation.
24.3 The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel the Promotion or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
24.4 The onus rests on the Participants to check the website for updates to the Terms and Conditions.
24.5 No liability shall lie on the Promoter in favour of any Participant, and/or third party arising from such cancellation, suspension, or termination. Therefore, the Participant waives his/her right which he/she may have against the Promoter and hereby acknowledges that he/she will have no right of recourse or claim of any nature whatsoever against the Promoter.
24.6 The Promoter’s decision is final, and no correspondence will be entered into. The decision of voucher distribution is solely at the discretion of Cadbury South Africa.
24.7 If in part or all of any clause of the Terms and Conditions is illegal, invalid or enforceable:
24.8 It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible,
24.9 Winners will accept the prize as is and at their own risk.
24.10 The Promoter reserves the right to substitute the prize for a different prize of similar value.
24.11 The Promotion is in no way sponsored, endorsed, or administered by or associated with Meta i.e. Whatsapp, Facebook, Threads and Instagram.
24.12 If in part or all of any clause of the Terms and Conditions is illegal, invalid or enforceable:
24.12.1 It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible,
24.12.1 It will be severed from the Terms and Conditions, and the remaining provisions of the Terms and Conditions will continue to have full force and effect.

All Terms and Conditions are subject to the laws of Republic of South Africa, and should a doubt or dispute occur, it will be taken before the courts of Republic of South Africa.
The Promotion is not applicable in conjunction with any other offers/promotions offered by the Promoter.
